Labor law

Proper establishment, fulfillment and termination of employment relationship is in the interest of its both parties, therefore such a relationship should be accompanied by mutual trust and respect. However it happens that due to the significant social and economic role of the labor law and dynamic changes of regulations, the professional legal aid becomes necessary. Our legal services related to the labor law are addressed to both employees and employers. 

For employers, we offer the following legal services:
  • drawing up employment documentation, including employment agreements, statements about establishment and termination of employment relationship, confidentiality agreements, non-competition agreements (so called loyalty agreements),
  • creating in-house labor law sources such as corporate collective labor agreements, work regulations, remuneration regulations, employee benefit fund regulations,
  • counselling in tax optimization with regard to employment,
  • drawing up legal opinions,
  • creating codes of conduct (compliance rules), anti-mobbing and anti-discrimination procedures,
  • coordination of negotiations between employers and employees/ employees’ representatives,
  • representation during audits performed  by state authorities such as the National Labor Inspectorate, Social Insurance Institution, Tax Office and drawing up responses to post-audit statements,
  • representation in disputes with employees and employees’ representatives, including both pre-litigation stage and representation before courts and state institutions,
  • support in hiring foreign citizens,
  • support for accident investigation teams determining work accident circumstances,
  • legal aid in case when the employing entity is taken over by another employer,
  • coordination of collective redundancies,
  • labor law trainings addressed to management teams, HR managers and employees and employees managing the company on behalf of the employer,
  • implementation of personal data protection rules among employees authorized to process personal data, and secondarily trainings and audits related to the observance of implemented procedures.

For employees, we offer the following services:
  • individual counselling and consultations related to labor law, including but not limited to employee claims, claims on proving an employment relationship, reinstatement or declaring the termination notice ineffective, as well as in cases referring to work accidents, work-related accidents – on the way to/from work, and accidents equal to work accidents, in cases related to confidentiality obligation, non-competition (loyalty agreements), mobbing, discrimination, violation of employee’s personal rights,
  • representation in disputes with the employer, including both pre-litigation and litigation stage,
  • representation before such state authorities as the National Labor Inspectorate, Social Insurance Institution, Tax Office,
  • drawing up legal opinions,
  • coordination of negotiations between employers and employees/ employees’ representatives.
We offer legal aid also in case of other than employment contract-based relationships.
